The paper examines the “fair wage” rules introduced by Article 7 of Decree-Law No. 62/2026, converted into Law No. 112/2026. The provision requires private-sector employers to guarantee the overall economic treatment set by national collective agreements signed by the comparatively most representative organisations. After tracing the legislative path from Delegating Law No. 144/2025 to the decree-law, and framing its constitutional dimension in light of Articles 36, 39 and 41 of the Italian Constitution, the paper analyses the main issues raised by its application.
36, 39 e 41 Cost., vengono analizzati i principali nodi applicativi.

Abstract
The paper examines the “fair wage” rules introduced by Article 7 of Decree-Law No. 62/2026, converted into Law No. 112/2026. The provision requires private-sector employers to guarantee the overall economic treatment set by national collective agreements signed by the comparatively most representative organisations. After tracing the legislative path from Delegating Law No. 144/2025 to the decree-law, and framing its constitutional dimension in light of Articles 36, 39 and 41 of the Italian Constitution, the paper analyses the main issues raised by its application.| File | Dimensione | Formato | |
